Terms of Service

These Terms of Service govern all quotes, orders, and services provided by benjima ("we", "us"). By placing an order with us, you ("the client") agree to these terms.
1. Quotes & Orders
- All quotes are provided in writing and are valid for 30 days unless stated otherwise.
- An order is confirmed when the client approves the quote and pays the agreed deposit.
- Quoted prices include the specifications listed in the quote only; changes after confirmation may adjust price and timeline.
2. Payments
- A deposit (typically 50%) confirms your order and books your production slot.
- The balance is due before shipment. Orders ship only after full payment is received.
- Accepted methods: bank transfer, PayPal, Stripe, Western Union, and card payments — details are provided with your invoice.
3. Samples & Approval
- Every bulk order starts with a physical or photo/video sample for your approval.
- Production begins only after written sample approval. The approved sample becomes the quality benchmark for the bulk order.
- Sample costs are typically adjusted against your production invoice.
4. Production Timelines
Standard production is 7–20 working days after sample approval and deposit, depending on order size and customization. Your confirmed timeline is stated in your quote. Timelines exclude shipping (see our Shipping Policy) and delays caused by late approvals, design changes, or events outside our control.
5. Custom Goods, Returns & Defects
- All products are custom-manufactured to your specification and are therefore non-returnable and non-refundable, except in the case of manufacturing defects or deviation from the approved sample.
- Defect claims must be reported within 7 days of delivery with photos. Verified defective pieces are remade, replaced, or credited at our discretion.
6. Intellectual Property
- All designs, logos, and brand assets you provide remain your property. We never reuse or resell your designs.
- You confirm that you own or are licensed to use all artwork you submit; benjima is not liable for third-party IP claims arising from client-supplied designs.
- We may photograph production for quality records; we only feature your products in our portfolio with your permission.
7. Liability
Our total liability for any order is limited to the amount paid for that order. We are not liable for indirect losses such as lost profits, missed events, or business interruption.
8. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, courier disruptions, or government actions. We will always communicate promptly and work on the fastest alternative.
9. Governing Law
These terms are governed by the laws of Pakistan. Both parties agree to attempt good-faith resolution of any dispute before pursuing formal proceedings.
